Changes to the Capital Finance System

Dear Ms Blackman,
I refer to the consultation paper in respect of the above issued under ISBN 978 1 4098 2030 7.
ACES is the Association of Chief Estates Surveyors in the Public Sector. It is a national organisation which represents
the professional heads of property and asset management services in local authorities in England, Scotland, Wales and Northern Ireland
senior property management professionals in other public sector organisations including the Valuation Office Agency, fire and police authorities and government offices
senior surveyors working in the private sector who regularly provide professional services to their public sector clients
With about 400 members, we represent some 250 public sector bodies throughout the UK. As such, we are grateful for the opportunity to comment on these proposals.
ACES strongly supports the extension of the concession to allow costs of disposal to be set-off against the capital receipt on non-housing sales. However, we equally strongly object to the proposal to cap these costs at 2% as we think that any restriction at this level is unlikely to achieve the aim of the regulations i.e. to encourage more sales of underused public assets. ACES does not see the need to cap these costs and believes that the full costs, properly accounted for, should be allowed to be set-off against the receipt. The 2% cap is likely to cover little more than an agent's fee in securing a sale, let alone costs associated with site preparation, reports, drawings, planning costs and so forth. In the regulatory framework in which we operate today these are increasingly stringent, time consuming and expensive.
ACES strongly recommends that the cap is lifted altogether to bring it in line with the position that exists in relation to housing disposals. However, if a cap is considered necessary (not that ACES believes it is) then it should be significantly lifted in order to cover those likely costs. Should the Department wish to discuss the quantum of a realistic cap if one is felt to be required then ACES will be pleased to offer further advice.
